This post is being written to conclude and recap my series on filing for divorce in the state of Florida when one of the spouses is not a resident of the state. I considered it important to write on this topic as it is common for spouses to have already been separated for a period of time before one files for divorce. I addressed a number of topics over my recent articles. Issues which I analyzed include:

There are multiple reasons why I chose to address these particular topics. First, one cannot simply move to our state and file for divorce. They must be able to satisfy the residency requirements prior to filing. One may file immediately, however, if their spouse lives in the state and meets the residency requirements. Second, understanding what the Court considers, when determining whether one is a “resident,” is important. Third, one may file for divorce if they live out of state but their spouse is a resident. This may be necessary if the matter involves child custody or spousal support. Fourth, while one may be able to file here while their spouse lives out of state, the Court may lack jurisdiction on the issue of alimony.
An important point that I stressed in each of these articles is that one should contact an attorney immediately if they or a family member are considering ending a marriage.
