Couple drinking coffeeThis is the first post in a series I will be writing to  address a topic that clients often have questions about – whether it is alright to begin dating again during the divorce process. The interest in this topic is obvious; following a separation from one’s partner it is natural to be eager to move on with one’s life. However, it is important to be cautious and ensure that the particulars of a divorce settlement are not negatively impacted due to choices one makes in their personal life.

In my upcoming posts I will be addressing the issues that clients frequently have questions about. Issues I will discuss in greater detail include:

  • Is it alright to move in with a new girlfriend or boyfriend while a divorce is pending?
  • Should one be concerned about how much they spend on dating?
  • Can dating during divorce hurt one’s chances of gaining joint custody?
  • If a divorce is dragging on, how can it be wrapped up more quickly so that one can get remarried?

Dating during a divorce can either be no big deal or a tricky concept depending on the circumstances of a case. If the relationship has been over for a long period of time, both partners are ready to move on, and each partner is fairly financially independent, then dating before a divorce is finalized may be no big deal. However, if the divorce is contentious, if a great deal of shared assets are involved, if one partner did not want the marriage to end, or if one partner is financially dependent on the other then dating while negotiations are still pending could potentially turn into one more thing to argue over. For many people the decision to begin dating again should be made after carefully weighing the pros and cons and making an informed decision with regards to what is best for their personal situation.

If you are going through a divorce and are unsure if stepping into the dating pool could negatively impact your settlement then it is best to discuss your concerns with your divorce attorney.
