I considered this a worthy topic to address due to the fact that life circumstances change over time and the original alimony terms may no longer be fair or practical. I chose to discuss these particular topics for multiple reasons. First, Florida allows an individual to seek an adjustment when there is a substantial, material, and unanticipated change in circumstances. A temporary or slight change in income or expenses is not likely to be sufficient for a Court to modify alimony. Rather, the change must be ongoing and significant. Second, the process of requesting a modification involves filing a formal request and providing evidence that proves a change in circumstances. A qualified attorney can help ensure all procedures and deadlines are followed strictly to avoid delays or a dismissal. Third, the discovery process is a necessary part of the legal process. It is where both sides are able to gather evidence such as financial records, employment information, and more when a modification request is contested. Finally, the alimony modification may need to go to trial if the parties cannot agree on a new alimony amount. A Judge will evaluate the evidence presented from both sides and determine whether a change is warranted.
