Black judicial gavel on woodThis is my next article in a series discussing the benefits of prenuptial agreements in Melbourne, Florida. My last article addressed how signing a prenup can result in a less stressful marriage marked with more open communication and fewer arguments. It also made the point that people should discuss all aspects of a prenup with an attorney before signing any agreement. In this article, I will be discussing why it is so important to retain an experienced prenuptial agreement attorney. If you or a family member need help drafting a prenuptial agreement or modifying an existing one then contact my office to speak with a lawyer.

An error in a prenuptial agreement can lead to future problems

Mistakes in a prenuptial agreement can significantly impact its effectiveness. The enforceability of an agreement could be challenged in court if certain requirements are not met. One common error in prenups that can lead to problems in the future is vagueness. Unclear language can create confusion over the intention of the parties related to asset division, spousal support, or property. Omitting important information or provisions like a full disclosure of assets or a waiver of certain rights can also lead to legal challenges down the road. A Florida Court may rule an agreement unenforceable if it finds one party did not enter into it voluntarily, if it is grossly unfair, or if there was not a reasonable disclosure of the other party’s assets and debts.

Consider this example. A couple, Sarah and Carlo, decided to draft their own prenuptial agreement using a template they found online. They modified the language to exclude their respective small businesses but did not include any information about how to handle growth in those businesses that occurred during the marriage. The two divorce after a decade. Carlo’s business grew substantially during the marriage, and Sarah claims she is entitled to a share of that growth because of how she helped his business. Carlo argues that the prenup protects his business interests in full, but because of the vague language, the court finds the agreement does not apply to the businesses.

An experienced lawyer can help Melbourne residents to ensure that their prenup is drafted correctly

The best way to avoid problems in the future related to a prenuptial agreement is to work with a knowledgeable attorney. A skilled attorney understands all the relevant laws and specific requirements that must be met in order for a prenup to hold up in Court. They will begin by learning about an individual’s financial situation, future plans, and goals for the agreement. A lawyer may ask “what if” questions that a person seeking a prenup may not have considered. For example, what happens if one party receives an inheritance? What if one spouse quits their job to raise children? What if the couple sells property and relocates? Each of these could have significant implications on how assets are classified, divided, or protected in the event of separation. These conversations help to ensure a prenuptial agreement is tailored to an individual’s unique circumstances.

Some couples may be hesitant to hire an attorney because of the upfront cost. However, the cost of a properly drafted prenup is significantly less than the potential cost of litigation resulting from a challenged agreement or a highly contested divorce. A clear, fair, and legally enforceable agreement can save both parties from the stress and cost of litigation in the future.
