I chose to address these particular topics for several reasons. First, Florida is like other states in the Union in that the rights of a dad are recognized in our state as long as paternity has already been established. If paternity has not been established, however, then one is without legal rights in regard to their child. Second, the extent to which a father may exercise his rights will depend on whether the parties have been married and whether a custody order is in place. Finally, if one is struggling to gain visitation from the mother then the necessary step will be to obtain a child custody order.
A common issue that I stressed in each of these articles is that dads should speak with an attorney as soon as possible if they are involved in a family law dispute. Engaging in back-and-forth arguments with the mother will often hurt one’s case more than it will help it. Also, such arguing with the mother is likely to be seen as acting against the best interests of the child.
